Why not give the baby up instead?

Excerpts italicized:

An Ohio appeals court has reversed a woman's murder conviction in her baby daughter's burning death in a microwave oven.

The 2nd District Ohio Court of Appeals in Dayton made the ruling Friday in the case of China Arnold, sentenced in 2008 to life in prison without parole for the death of her month-old daughter.

Arnold was sentenced following her second trial. The first ended in a mistrial.
Arnold continues to deny killing 28-day-old Paris Talley in August 2005.

Also, excerpts from an earlier AP/MSNBC article:

A mother was arrested on suspicion of murdering her newborn daughter by putting the baby in a microwave oven.
China Arnold, 26, was jailed Monday on a charge of aggravated murder, more than a year after she brought her dead month-old baby to a hospital. Bail was set Tuesday at $1 million.

“We have reason to believe, and we have some forensic evidence that is consistent with our belief, that a microwave oven was used in this death,” said Ken Betz, director of the Montgomery County coroner’s office.

He said the evidence included high-heat internal injuries and the absence of external burn marks on the baby, Paris Talley.

Why can we not say to ourselves that when people commit evil acts, that they may not be “insane”? War crimes in years past could easily be described as “insane” acts of cruelly, but why could we so easily put people to death for those crimes yet be so afraid to convict those in our own society? Is it a number? 1 vs. 1000?  At what point does an “insane” act become a punishable crime?
